Affordable Sacramento Divorce, Part 2

by | Feb 17, 2014 | Firm News |

There are other ways for parties to make their Sacramento divorce more affordable.  Parties can hire a Sacramento attorney mediator.  Sacramento divorce mediation can save costs because both parties use the same Sacramento divorce attorney to mediate their divorce.  The parties agree to avoid court and work through their disputed issues with the mediating attorney’s input.  (This is different than in most Sacramento divorce litigation in which each party hires their own attorney and uses their attorney to address disputed issues in court and to communicate with one another.  This can be an effective way to handle a divorce, but the cost of the attorneys and the court battles can become very expensive to both parties. Sacramento divorce mediation is different than the Sacramento divorce litigation model because in mediation, the parties communicate directly to the mediator who is trained to help the parties reach an agreement.  When both parties are committed to proceeding through this process, it can be much more cost-efficient and result in an arrangement that is more satisfactory to all parties.

When the parties litigate their Sacramento divorce case, the parties struggle to predict the judge’s orders.  As all experienced family law attorneys will state, different judges will interpret facts and the law differently which can cause varying results for the parties.  Also, attorneys will present issues and legal arguments differently than other attorneys to the judge.  In Sacramento divorce mediation, the parties are empowered because they are reaching their agreements together, and such decisions are more likely to be well-planned.  If the parties cannot reach an agreement right away, a Sacramento divorce mediator will provide a summary of the law, review the available options, and help the parties resolve the issue with a mutually agreeable solution.

In litigation the focus is often on the past. In mediation, the focus is on the future.  The litigation process is not confidential because the courtroom is open to the public and generally any communications and party pleadings are in the Sacramento divorce court file and are also open to the public. By contrast, the mediation process and mediator records are confidential.  Litigated divorce cases often take 12 months or longer to resolve. In contrast mediation cases can be resolved anywhere between 1 and 4 months depending on the complexity of the issues involved and the commitment of each participant to providing all the necessary paperwork in a timely fashion.
